These Terms & Conditions ("Terms") govern your access to and use of the MAAK Motorsports website, products, drops, and events (collectively, the "Services"), operated by MAAK Motorsports ("MAAK," "we," "us," or "our"). By using the Services, purchasing a product, or attending an event, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase from us. If you are under 18, you may use the Services only with the involvement of a parent or legal guardian who agrees to be bound by these Terms.
You agree to provide accurate information and to use the Services only for lawful purposes. You may not: (a) interfere with or disrupt the Services; (b) attempt to gain unauthorized access to any systems; (c) use bots, scrapers, or automated tools; (d) resell products for commercial purposes without our written consent; or (e) use the Services to violate any law or the rights of others.
We offer apparel, accessories, and novelty automotive items, including limited "drops." Products and quantities are subject to availability and may be changed or discontinued at any time. We strive for accuracy, but we do not warrant that product descriptions, colors, images, or pricing are error-free. Colors may vary by screen. We reserve the right to correct errors and to refuse or cancel any order — including after an order confirmation — if we suspect an error, fraud, or a violation of these Terms.
By placing an order you make an offer to purchase. All orders are subject to acceptance by us. Payment is processed by our third-party payment provider; you authorize us and our provider to charge your selected payment method for the total amount, including taxes and shipping. You represent that you are authorized to use the payment method provided.
Except as required by law, all sales are final. Please review our Refund & Cancellation Policy before purchasing. Order cancellations are only permitted within the window described in that policy.
Shipping, processing times, and delivery are governed by our Fulfillment Policy. Title and risk of loss pass to you upon our delivery of the product to the carrier.
Discount codes and promotions are subject to their own terms, cannot be combined unless stated, have no cash value, and may be modified or ended at any time. One code per order unless otherwise noted.
MAAK hosts car meets, cruises, and community events. Attendance is voluntary and at your own risk. By attending you agree to:
To the fullest extent permitted by law, you release and waive claims against MAAK, its organizers, volunteers, sponsors, and venue partners for any injury, loss, or damage arising from your attendance, and you agree to indemnify them as described in Section 12.
Our events may be photographed or filmed. By attending, you grant MAAK an irrevocable, royalty-free license to use images and video that include you or your vehicle for marketing and promotional purposes, without compensation. If you do not wish to be featured, notify a MAAK organizer on site.
If you tag us or submit photos, comments, or other content, you grant MAAK a non-exclusive, worldwide, royalty-free license to use, reproduce, and repost that content across our channels with credit where practical. You represent that you own or have permission to share what you submit.
The MAAK name, logos, the gauge mark, the checkered-flag identity, designs, text, and graphics are owned by MAAK or its licensors and are protected by intellectual-property laws. You may not copy, reproduce, sell, or create derivative works from them without our prior written permission.
You agree to indemnify, defend, and hold harmless MAAK and its members, organizers, volunteers, and partners from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your attendance at events, your content, or your violation of these Terms or any law.
The Services and products are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. Novelty plates and frames are sold subject to our Vanity Plate Disclaimer.
To the fullest extent permitted by law, MAAK and its members, organizers, volunteers, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from the Services, products, or events. Our total aggregate liability for any claim will not exceed the amount you paid to us for the product or order giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. You agree that any dispute will be resolved exclusively in the state or federal courts located in Denton County, Texas, and you consent to their jurisdiction, except where prohibited by the law of your home state. Before filing anything, you agree to contact us first at support@maakmotorsports.com to try to resolve it informally.
Under California Civil Code §1789.3, California residents are entitled to the following consumer-rights notice: the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N-112, Sacramento, CA 95834, or by telephone at (800) 952-5210 or (916) 445-1254. California residents also have specific privacy rights described in our Privacy Policy, and our posted Refund & Cancellation Policy applies as required by California Civil Code §1723. Nothing in these Terms waives any non-waivable right you have under California law.
We may update these Terms at any time. Changes are effective when posted with a new effective date. Your continued use of the Services means you accept the updated Terms.
If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms are the entire agreement between you and MAAK regarding the Services. You may not assign these Terms; we may.
